Pesticide misapplication

Retained opinion work on claims that a structural pesticide application was wrong: the wrong product, the wrong rate, the wrong place, or the wrong precautions.

What I review

  • Application records: product, EPA registration number, amount, rate, location and time.
  • The product label, which is the legal starting point for how a pesticide may be used.
  • Applicator licensing, certification category and training records.
  • Customer notices, re-entry instructions and the sequence of events after the application.

What I give an opinion on

  • Whether the application followed the label and the applicable state records rules.
  • Whether the product and method fit the pest and the site.
  • Whether the records are complete enough to show what was applied, where and when.
  • What a reasonable applicator would have done differently, if anything.

In Utah, pesticide application records are governed by Utah Admin. Code R68-7-11(11).
